Terms and Conditions for the issue and use of ICICI Bank Fast Forward Card
These Terms and Conditions apply to and regulate the usage of Fast Forward Card Services as offered by ICICI Bank Limited.
1. DEFINITIONS
For the purposes of these Terms and Conditions, the terms specified below shall have the meaning set forth:
1. "Card" shall mean the Fast Forward Card issued by ICICI Bank.
2. “Customers” shall mean Savings Bank Account Holders of ICICI Bank to whom the Card is issued by ICICI Bank and which is valid and subsisting.
3. "ICICI Bank” shall mean ICICI Bank Limited, the proprietors of the Card, its successors, assigns and nominees appointed by ICICI Bank.
4. "ICICI Bank 24 - Hour Customer Care Centre" refers to ICICI Bank Phone Banking Service provided by ICICI Bank, which shall be available to the Card Members. All Card Members availing of the ICICI Bank 24 - Hour Customer Care Centre shall be bound by the Terms & Conditions stipulated by ICICI Bank in this regard. These Terms & Conditions governing the Phone Banking Service are available on the Terms & Conditions webpage on the website www.icicibank.com.
5. “Services” shall include personalized services for the Customers relating to any enquiry by the Customer, requests for funds transfers, demand drafts, Pay Orders or any other facility as may be offered by ICICI Bank through ICICI bank branches. These Terms and conditions shall apply to the new or additional facility as if the same was incorporated herein originally.
2. ELIGIBILITY AND ISSUE OF THE CARD
ICICI Bank shall issue the Card to such Customers of ICICI Bank having an existing Savings Bank Account with ICICI Bank with a quarterly balance of Rs.1,00,000/- (Rupees One Lakh only) or more unless otherwise notified by ICICI Bank from time to time. ICICI Bank reserves the right to increase or modify the balance requirement from time to time at its sole discretion. The Card shall be valid for the period as embossed on the Card.
ICICI Bank shall renew the Card on such terms as it may decide from time to time.
The Card shall not be issued to the Current Account holders.
The Card shall automatically terminate in event of closure of the Savings Account with ICICI Bank.ICICI Bank reserves the right to withdraw or suspend, at any time, any Services as offered to the Customers.
3. USAGE OF THE CARD
The Card may be used by the Customers to avail of the services at select ICICI Bank branches* as listed hereunder. ICICI Bank may at its sole discretion make amendment to the list and update the same on the Terms & Conditions webpage on the website www.icicibank.com and the Customers shall be required to regularly update themselves of such amendments.
The Card is not an ATM/ Debit / Credit Card and cannot be used for effecting any financial transactions.
The Card will be used to identify the Customers at *ICICI Bank branches for offering Services. ICICI Bank shall endeavor to provide designated counters at *ICICI Bank branches for providing Services to the Customers.
The Card can be used only by the Customer visiting the branch in person with the Card and cannot be used commercially for any other purpose.
The Services shall not be offered to the Customer if the Card is not presented/produced by the Customer at the Branch for availing of the Services.
4. ACCEPTING THE TERMS AND CONDITIONS
Upon first usage of the Card, the Customer shall be deemed to have accepted all the terms & conditions contained herein. The Card cannot be used prior to the valid date or after the expiration date embossed on the face of the Card, unless otherwise notified by ICICI Bank.
5. CARD SERVICES
The Card is the property of ICICI Bank. It is not transferable and the usage is subject to the terms mentioned herein and any additional conditions stipulated by ICICI Bank from time to time.
6. SUSPENSION OF THE CARD FACILITY
ICICI Bank, at its sole discretion, reserves the right to, either temporarily or permanently, withdraw the privileges on the Card and/or cancel the Card at any time without giving any notice or assigning any reason thereof. In case of a temporary withdrawal, the privileges may be reinstated by ICICI Bank at its sole discretion.
7. BREACH
In the event of any breach of these Terms and Conditions by any Customer, notwithstanding any other provision of these Terms and Conditions, the Customer will remain liable for any loss directly or indirectly resulting from such a breach.
8. LOST, STOLEN OR MISUSED CARDS AND LIABILITY THERE AFTER
The Customer is responsible for the security of the Card and shall take all steps towards ensuring that the Card is not misused. If a Card is lost or stolen, the Customer must report the loss/theft to ICICI Bank forthwith. ICICI Bank will, upon adequate verification, terminate the relevant Card. ICICI Bank may then issue a fresh Card to the Customer at its sole discretion. Cards which have been reported lost, or stolen or damaged, if found should be forthwith handed over to ICICI Bank.
9. INDEMNITY
In consideration of ICICI Bank providing the Services, the Customer agrees to indemnify and keep safe, harmless and indemnified ICICI Bank from and against all actions, claims, demands, proceedings, loss, damages, costs, charges and expenses whatsoever which ICICI Bank may at any time incur, sustain, suffer or be put to as a consequence of or arising out in good faith in course of provision of the Services.
10. MODIFICATION
ICICI Bank has the absolute discretion to amend or supplement any of the terms and conditions at any time and will endeavour to give prior notice of fifteen days by email or by displaying on the website www.icicibank.com or in any manner as per the discretion of ICICI Bank, and such amended terms and conditions will thereupon apply to and be binding on the Customer.
11. MISCELLANEOUS
(i) ICICI Bank reserves the right to offer the Customer, whose accounts have been maintained in good standing as per ICICI Bank policy, certain facilities, memberships and services on such Terms and Conditions as it may deem fit.
(ii) Any termination of the Card, because of a violation of these terms, shall result automatically in the termination of the Card and the Services.
(iii) ICICI Bank shall not be liable, in any way, to the Customer, in case of defect or breach in the performance of carrying out such services or the non-performance thereof, by ICICI Bank.
(iv) The Customer shall forthwith notify ICICI Bank of any change in the address for communication as per ICICI Bank’s records. ICICI Bank reserves the right to change the address of the Customer in its records if such change in address comes to the notice of ICICI Bank. The responsibility shall be of the Customer to ensure that ICICI Bank has been informed of the correct address for communication, and ICICI Bank disclaims all liability in case of an incorrect address resulting in any loss or liability for the Customer.
(v) The Customer agrees to adhere to and comply with all such terms and conditions as ICICI Bank may prescribe from time to time for Services availed of by the Customer, shall constitute legally binding and valid transactions when done in adherence to and in compliance with the terms and conditions prescribed by ICICI Bank for such Services, as may be prescribed from time to time.
(vi) The Customer and ICICI Bank hereby agree that any legal action or proceedings arising out of these terms and conditions shall be brought in the courts or tribunals at Mumbai in India and irrevocably submit themselves to the exclusive jurisdiction of such courts and tribunals. ICICI Bank may, however, in their absolute discretion commence any legal action or proceedings arising out of these terms and conditions in any other court, tribunal or other appropriate forum, and the Customer hereby consents to that jurisdiction.
(vii) Any provision of these terms and conditions which is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of prohibition or unenforceability but shall not invalidate the remaining provisions of these terms and conditions or affect such provision in any other jurisdiction.
